Join our panel of leading practitioners and scholars for two panel discussions considering recent developments in Criminal Justice Litigation, Equality, and Discrimination Law in Canada.
The first panel will focus squarely on Section 15 of the Charter, and the implications of recent trial and appellate court decisions in
Fraser v Canada (Attorney General) (2020 SCC 28),
R v Sharma (2020 ONCA 478), and
R v Turtle (2020 ONCJ 429) for criminal justice practitioners.
Topics Will Include:
- Special issues surrounding the framing of section 15 challenges;
- What Fraser and the law on adverse effects discrimination mean for criminal practitioners; and,
- Evidentiary considerations in section 15 challenges.
The second panel of this event will focus on racial discrimination and sentencing. Crown and defence counsel from the challenging litigation in
R v Morris will provide practical and considered insight in conjunction with related scholarly perspectives on this important subject.

- Impact of Race and Cultural Assessments (“IRCAs”)
- Evidentiary records and sentencing
- Interviewing clients
- Cross-jurisdictional comparisons of approaches to advocacy in sentencing
